There is no single law regarding online gambling in India, which regulates it throughout the country. But there are some states which have made batting legal by enacting some laws themselves. Sikkim was the first state in India to consider enacting a law regarding online gambling.
Sikkim had made a law regarding online gambling (The Sikkim Online Gaming (Regulation) Act, 2008). Under which three different types of licenses were issued and it was said to be regulated through them.
Online lottery has also been legalized by Sikkim in its state. Apart from Sikkim, Goa is also one such state which has legalized online gambling. Online gambling is also legal in Daman.
Betting and gambling is completely illegal in these states
Andhra Pradesh and Telangana are two such states in India, which have banned online and offline betting, gambling in their states. The Tamil Nadu government is also considering enacting a law to prevent online gambling in the state. For this, a bill was also introduced in the Tamil Nadu Assembly.
This bill was also passed by the assembly on 19 October 2022. But this bill was returned after 4 months by N Ravi, the Governor of Tamil Nadu. Now Tamil Nadu Government is talking about putting this bill again on the table of the House.
Currently gambling laws
At present, there is no such law in India, which regulates online gambling in the entire country. However, there is definitely a law regarding offline gambling and betting. The Public Gambling Act, 1867 regulates betting in India. But this law was made at a time when there was no mention of internet. That’s why it seems difficult to ban online gambling or betting. However, it definitely helps in this work.
The Gambling Act, 1867 divides betting or gambling into two parts.
1- Game of chance: – If you are investing money in a game and the result, profit, loss are all based on luck. This is called Game of chance. This is illegal in India.
2-Game of skill: – If you use your skills while playing a game and earn money through it, then it is called Game of skill.
For this reason, you will find two types of betting apps in India. First, those who run completely on Game of chance. They are also considered illegal and the government keeps on issuing advisories against these apps. This includes many apps like 1xbet ,betway, fairplay.
On the other hand, there are those apps, which work on Game of skill. These apps are also registered in India. They also pay tax to the government and they are known as fantasy sports apps. This includes apps like dream 11, my11circle.
What is the provision of punishment?
The Public Gambling Act, 1867 has made a provision that if someone gets or does betting, then there is a provision of a fine of Rs 200 and a punishment of 3 months.

Due to strict laws, India is far away in this list.
